The Ontario site is licensed in the way Canadian law expects: the province, through iGaming Ontario, conducts and manages the games and the operator follows the AGCO’s standards. The second site is licensed by the Kahnawake Gaming Commission and not licensed by any province. The commission bases its authority on the jurisdiction of the Mohawk Council of Kahnawake, and federal and provincial authorities have not recognized it as a licensing body under the Criminal Code. For you, the practical gap is this. On the Kahnawake-permitted site your province’s rules, complaint routes and province-wide self-exclusion do not apply. If a payout dispute goes badly, you have no provincial regulator to turn to. We do not say playing there is a crime for the player; we say the protection is thinner. Players in Ontario should use the Ontario site, and players elsewhere should weigh their provincial crown site first.

Is Spin Away legit, or grey market?

In Ontario, yes in the regulatory sense: Spin Away is on the iGaming Ontario directory and you can check it there. For the rest of Canada the brand is a real, permitted operator under Kahnawake, not a fake site, but it is grey market from a provincial point of view.
