A Kahnawake licence is not a provincial licence. The Kahnawake Gaming Commission (KGC), based in the Mohawk Territory of Kahnawake near Montreal, is one of the most common licensing bodies for online casinos that accept Canadians. It issues authorizations under its own Interactive Gaming Regulations. A site licensed only by the KGC is therefore offshore from a Canadian legal point of view: no province licenses it, and provincial rules and complaint routes do not cover it.
Who the Kahnawake Gaming Commission is
The Commission relies on the inherent jurisdiction of the Mohawk Council of Kahnawake. It first enacted interactive gaming regulations in 1999, and the current version is dated 14 January 2026. Those regulations set the requirements for the operators it authorizes.
What the KGC is not matters as much. Under section 207 of the Criminal Code, only a province, or a body acting for it, may conduct and manage online casino games. Federal and provincial authorities have not recognized the KGC as a licensing body under that section, and no definitive court ruling has settled the legal status of KGC-licensed sites that serve Canadians.
Kahnawake licence versus a provincial licence
| Question | KGC-licensed site | Crown or Ontario/Alberta licensee |
|---|---|---|
| Licensed by your province | No | Yes |
| Provincial standards on ads, bonuses and limits | Do not apply | Apply |
| Covered by Ontario’s BetGuard self-exclusion | No | Yes, in Ontario |
| Who handles complaints | The operator, then any procedure the KGC offers | The operator, then the provincial system |
On our score, a Kahnawake licence earns 12 of the 30 points for licence and legal standing, against 30 for a crown site or provincial licensee. The details are on how we rate.
The court cases worth knowing about
Two disputes shape the picture. In November 2022, the Mohawk Council of Kahnawake filed a legal action challenging Ontario’s model, in which iGaming Ontario conducts and manages the market while private operators run the sites. The Ontario Superior Court dismissed it in 2024, and an appeal was filed with the Court of Appeal for Ontario; we have not confirmed its outcome.
Separately, trade press reported in February 2026 that the Quebec Court of Appeal dismissed an appeal by the KGC in the Magic Palace matter, upholding that Quebec courts can review the Commission’s decisions. Neither case answers the wider question of whether KGC-licensed sites may serve players across Canada.
What a Kahnawake licence means for you
Playing on a KGC-licensed site is not the same as playing on a site your province regulates. We do not say it is a crime for the player, because the law on that point is unclear. What is clear is the protection gap:
- Provincial limits on bonus advertising and terms do not apply.
- Provincial self-exclusion programs do not reach the site.
- Your provincial regulator cannot step in if a withdrawal is delayed or an account is closed.
- Some of these sites block players in Ontario, where a regulated market exists. We do not publish mirrors, VPN tips or other ways around those blocks.
How we write about KGC-licensed brands
Our operator data lists the Kahnawake Gaming Commission as a regulator for more than 20 brands, in a few cases alongside a Curacao licence. Each of those reports says so in plain words near the top: licensed by the Kahnawake Gaming Commission; not licensed by any province. Each has its own licence section, and none can reach a recommended verdict. The 20Bet review is one example. If you want a regulated option instead, our iGaming Ontario guide explains how to check a provincially licensed site.
Whatever site you use, the age and limit rules still matter to you. Free provincial help lines are listed on our responsible gambling page.
Questions readers ask
- Is a Kahnawake licence legal in Canada?
The KGC licenses sites under its own regulations, but no province recognizes it as a licensing body under the Criminal Code, and no definitive court ruling has settled the question. A KGC-licensed site is not licensed by any province.
- Is it illegal for me to play on a Kahnawake-licensed casino?
The law is unclear on the player's side, so we do not call it a crime. The practical issue is protection: provincial rules, self-exclusion and complaint routes do not cover these sites.
- Can I complain to the Kahnawake Gaming Commission?
Start with the operator and keep records: dates, amounts and the terms that applied. If that fails, look on the Commission's own website for any dispute procedure it publishes. A provincial regulator cannot take the case.
- Why do Kahnawake-licensed sites block Ontario?
Ontario has a regulated private market run through iGaming Ontario and the AGCO. Some offshore operators exclude Ontario players rather than operate there without registration.
